Privacy Notice Regarding the Processing of Personal Data (Article 13 of EU Regulation 2016/679 – GDPR)

In accordance with  the new EU Regulation No. 679/2016 on the processing of personal data  (General Data Protection Regulation – “GDPR”), which took effect on May 25, 2018, the personal data you provide to the Collegio Universitario Luciano Fonda will be processed  following the principles of legality, fairness, and transparency, while also respecting the confidentiality and the rights of data subjects.

The processing of personal data follows the rules set in this Privacy Notice. It explains how and why we handle personal data and describes your rights regarding this processing.

This Privacy Notice explains how personal data collected through various methods, including our website, registration forms, and other data collection approaches, is used.

1. DATA CONTROLLER

2. TYPES OF DATA COLLECTED

The personal data gathered may include:

  • Contact information: full name, home and mailing address, phone numbers, email address, along with the full name of a family member and their phone number and email address.
  • Identification data: place and date of birth, tax ID, ID document number, date of issue, and expiration date.
  • Payment information: bank account details or credit card data.
  • Educational and academic background: qualifications, certificates, and academic and professional history.
  • Professional background information of trainers, collaborators, and employees: qualifications, publications, educational, and professional history.
  • Financial information: ISEE (Equivalent Economic Situation Indicator), income from occasional self-employment, and registration with mandatory social security programs.
  • Health data: medical certificates pertaining to specific needs or special requirements.
  • Access and usage data: IP addresses, browsing activity on our website, cookies, and tracking tools, as defined in the dedicated Cookie Policy.
  • Personal images: photos and videos.
  • other information: any additional data voluntarily provided to the Collegio or requested by it.

3.  PURPOSE AND LEGAL BASIS OF DATA PROCESSING

The personal data collected will be used, processed, and stored for the following purposes:

  1. Communications: sending information related to the Collegio, admissions, residential services, events promoted by the Collegio, updates, and newsletters. The email address you provide may be collected and used by the Data Controller or by authorized third parties to inform you about the Collegio’s initiatives and activities.
    Your consent is required to process your data for this purpose.
  2. Candidate selection and evaluation procedures, as well as related communications: your data will be used to carry out selection processes and send relevant communications.
    The use of your data for these purposes does not require your consent, as it is necessary for the execution of pre-contractual measures. Without providing such data, we would not be able to proceed with your application to the Collegio Universitario Luciano Fonda.
  3. Conclusion of the agreement: Contractual purposes: this includes the contract with the Collegio, the housing agreement, and the signing of the Educational Pact (or the General and Academic Regulations).
    The use of your data for these purposes does not require your consent, as it is necessary for fulfilling contractual and institutional obligations. Without providing this data, it would not be possible to proceed with your admission to the Collegio Universitario Luciano Fonda.
  4. Provision of educational services:
    Management of registrations, attendance tracking to monitor compliance with the educational agreement, event organization, and issuance of certificates and diplomas.
    Personal data and student academic records will be used for activities carried out by the College in cooperation with the University of Trieste and the Italian Ministry of University and Research (MUR).
  5. Provision of residential services, including housing assignment and accommodation management.
  6. Administrative and accounting management: invoicing, payment processing, bookkeeping, and tax obligations. Your consent is required to process your data for this purpose.
  7. Activity Promotional purposes:
    Your data, including images and comments featuring you, may be published or disseminated, and reproduced on the College’s website, on social media, or through any other form of communication (such as print media), free of charge. Such processing may be carried out by the data controller only after obtaining your explicit consent.
  8. Security and fraud prevention: protection of our networks and your data.
  9. Service Improvement and Personalization:
    Analysis of educational needs, evaluation of course quality, and use of data for statistical, promotional, historical, or scientific research purposes, as well as for the recognition and accreditation of the College by the Ministry of University and Research (MUR).
    Where the performance of these activities requires the processing of sensitive data, your explicit consent will be requested.
  10. Compliance  with legal obligations

Your personal data are processed on the basis of the following legal grounds:

  1. For the performance of a contract, specifically to deliver residential and educational services.
  2. Based on your consent, for specific promotional activities or for processing operations not essential to the performance of the contract.
  3. Processing is necessary to comply with legal obligations, including tax, accounting, and regulatory requirements.
  4. Legitimate interest:
    To improve our services and ensure security.

4. Processing Methods

Data processing will be carried out at the operational premises of the Luciano Fonda University College and at any other location where the parties involved in such processing are located.

The processing will be carried out using both electronic and non-electronic means, in full respect of fundamental freedoms and without compromising your privacy. It will be guided by the principles of transparency and fairness, and limited to purposes that do not exceed those stated at the time of data collection.

The data will be stored at the operational headquarters of the Luciano Fonda University College, located at the former Military Hospital residence, Via Fabio Severo 40, Trieste. Electronic data will be stored on  secure serve located in access-controlled areas.

Data will be processed with due regard for confidentiality and integrity, through the adoption of appropriate security measures aimed at preventing data damage, loss, unlawful or improper use, and unauthorized access.

5. Disclosure and Dissemination of Data

The data provided to the College may be disclosed, solely for the purposes of the requested and necessary professional services, to professionals, service providers, or entities entrusted with certain activities carried out by the College.
In particular, data may be shared with employees, data processing personnel, and collaborators of Joyvy S.r.l. (including administrative, commercial, and legal staff) for matters related to housing services; as well as with companies providing telematic, IT, training, communication, administrative, accounting, tax, and social security services, acting as data processors.
Data may also be shared with the University of Trieste and the Ministry of University and Research (MUR).

Your personal data will not be disclosed beyond the aforementioned purposes, unless such disclosure is required by a specific provision of law.

6. Retention Period

Personal data will be retained for as long as necessary to ensure the proper and complete performance of the collaboration agreement, or to fulfill the purposes for which it was collected, in compliance with related legal obligations.

Upon expiry of the contractual period, or once the requested services have been fulfilled, personal data will be destroyed or anonymized in line with technical procedures for data deletion and backup. These data will be retained for a period of 24 (twenty-four) months.

7. CONFERIMENTO DEI DATI

Providing personal data is optional; however, it is strictly required for the preparation and execution of the admission form, the residence contract, and the Educational Agreement (or the Academic and General Regulations).

The provision of data is mandatory solely for those categories of data for which a legal obligation exists (i.e., as established by applicable laws, regulations, or orders from Public Authorities).

8. Refusal to Provide Data

Should the data subject refuse to provide the required personal data, the College may be unable to perform the related services.

9. Data Subject Rights

The data subject has the right, at any time, to access their personal data and to exercise all the related rights concerning the processing of such data.

These rights include the right to:

  1. To obtain confirmation of the existence of personal data concerning them and to receive access to such data;
  2. To be informed of the origin of the data, the purposes and methods of processing, and the logic applied in the case of processing carried out by electronic means.
  3. To request the updating or correction of inaccurate or incomplete personal data, to obtain restriction of processing, and, where applicable, to request data completion;
  4. To request the deletion, transformation into anonymous form, or restriction of personal data processed unlawfully;
  5. To object at any time to the processing of their personal data on grounds relating to their specific situation;
  6. To withdraw their consent at any time, without affecting the lawfulness of processing carried out based on the consent given before its withdrawal;
  7. o obtain the portability of personal data concerning them.
  8. To lodge a complaint with the Italian supervisory authority (Garante Privacy).
